Sara S. Linder is associated with the Sowards Law Firm in the areas of estate planning and litigation as well as employment law. Her approach to estate planning is to educate the clients regarding the various options and strategies available for a complete estate plan that is then designed for their specific needs. This approach results in a collaborative effort by Ms. Linder and the clients whereby the clients fully understand the process and are confident that their wishes are clear in their estate documents. The end results are clients who are confident about their estate plan and its cohesiveness as well as knowledgeable about how to proceed with changes to the plan if life-as it does-changes for them.
As a litigation attorney, Ms. Linder has represented both Trustees and heirs regarding disputed estate issues. Her approach as an advocate for the client is to ensure that the client is a partner in the process of litigation with her. It is important that the client is always informed, knowledgeable and involved in the process in order to insure that the client has all the information necessary to make decisions regarding litigation. Ms. Linder has been a litigation attorney for over twenty years and has been involved in numerous arbitrations, mediations, settlement conferences, hearings and trials. While the goal is most often to resolve issues through the use of her negotiation skills without the need and cost of litigation when it is in the best interests of the clients, she is prepared to proceed with necessary litigation on behalf of her clients to resolve an issue.
Ms. Linder has practiced in the area of employment law in excess of 20 years. She has represented large and small corporations and business as well as individual employee clients. She has counseled and represented clients in matters involving the Labor Commission, the Workers' Compensation Appeals Board, the Department of Fair Housing and Employment, and the Equal Employment Opportunity Commission regarding issues of hiring, overtime, wages, compensation, benefits, employment terminations and lay-offs, sexual harassment, hostile work environments, working conditions, independent contractor vs. employee status, state and federal labor statutes. She has reviewed and negotiated termination packages for executives. She has authored Employer/Employee Policy and Practices Handbooks as well as advised clients regarding issues specific to their needs due their industries.
Ms. Linder's legal experience has included teaching Constitutional Law while at the University of North Dakota Law School, selection as one of only 6 legislative interns with the North Dakota Legislature during her law school education, intern with the United States military JAG station in Grand Forks, North Dakota, first staff attorney for Cass County Court, Fargo, North Dakota, Deputy City Attorney for San Jose, California, instructor of City Planning at San Jose State University, Section Chair for Santa Clara Bar Association for Worker's Compensation, guest speaker for the California Bar Association, and Judge Pro Tem for the WCAB.
In addition to her legal practice, Ms. Linder has been a volunteer with the San Museum of Art since 2001 and a tutor for adult literacy with the Partners in Reading program in Santa Clara County since 2012.
